Taking photos at Routine Inspections   3 replies   2 voices

We have recently been contacted by one of our members using our Field Agent app about a complaint that arose from one of their tenants at a routine inspection.


The tenants weren’t confortable about photos getting taken of their possessions on the property managers phone and they felt this was insecure…
The tenants also claimed that it was against legislation that this was allowed.

The Property manager and ourselves contacted the office of trading of NSW and The NSW privacy commissioner and they both confirmed our assumptions that it was fine to take photos during an inspection. 

Our suggestion was to tailor the tenants letter advising them of the inspection to make them aware that photos will be taken during the Routine Inspection to give them adequate notice of how the inspection will be undertaken rather then catching them off guard at the inspection appointment.

Has anyone else been up against something like this and if so what was your reaction to the Tenants?

I am currently having this issue with a couple of my tenants.

Was there any additional comments made by the OFT or Privacy Commissioner that we could use to pass along to our tenants that raise this issue?

Do you include a notification to the tenants about the photos within your routine inspection letter to them?

Both parties advised there was no specfic clauses to say for or against photos getting taken.

No I didn’t include that as part of my letters and I had never thought about it until you mentioned it in your first post.

I’m definately going to update my letters though, thanks.
