Window glass was broken by the tenant. No disagreement there and glass has been replaced. (Owner has paid, letter for reimbursement from tenant sent.) However the new pane of glass is safety glass as required by the current standards. Tenant claims that this is an improvement to the property and the owner should contribute towards the cost. I haven’t discussed this with the owner yet because I can see both sides of the story but I tend to think the tenant is drawing a long bow and should pay the full amount. Thoughts please? |

I think the tenant is being a bit cheeky. It would have been illegal to replace the window with anything but safety glass as per australian standards. So in this instance the tenant should pay the full amount. If he had not broken the window it would not have needed replacing. This are only my views so I hope it helps :) |

With you there Anne… Australian Standards apply. But I’m a bit confused.. since when does a tenant pay for glass breakage.. unless deliberately done was it..? It’s a landlord insurable Claim, and would normally be handled that way here.. at worst you might have the tenant pay the excess on any claim..

Thank you Anne and Ian. I agree with you. :) Anne I like your logic, if the tenant hadn’t broken it, it would not have needed replacement! Ian, yes the damage was done by the tenant. Cheers, John. |

By John’s message I took it that the tenant takes responsibility for the damage. If it was only a small window it would not be worth an owner to claim it on insurance with an excess to pay. So I too would charge the tenant for the broken glass. |
