I’m just wondering if all NSW Property Managers have lodged their objections to the proposed changes to the NSW Residential Tenancies Act that makes the law horribly biased to tenants and will end up making almost every NSW landlord want to sell their investment! |

My main concern is the changes to the notice periods and the proposed change to ending a fixed term lease. I think the NSW government is only going backwards with the legislation and I can see more and more of our landlords selling up because the risk is too high |

I’ve spoken with Sam Kremer, Legal Counsel for the REINSW and they have some real concerns with these proposed changes. There’s talk within the industry that this set of changes will have a similar affect as the stupid Vendor Tax decision from the NSW Govt a few years back & send landlords/investors interstate once again. |

do you know which areas specifically Greg? Ashlee’s comments relating to increased notice periods and losing the End of Fixed term tenancy notice (which Vic other states do not have) are very valid. |

I’ve emailed Sam & put a call in for him to provide me with more info & enable me to provide more specific concerns. I know that allowing tenants to order air-conditioning repairs was an issue, but there were a number of other issues that he had some major concerns with. I’ll post something as soon as I know more. |

From what I’ve read on apmasphere earlier I thought the notice period in NSW was already longer than what we have in QLD. What are they now and what are they proposing? Why are they proposing a longer period? Who is this benefiting? What do you mean losing End of Fixed term tenancy notice? Are they proposing a tenant can just walk in on the last day with their keys with no notice at all and just leave you and the owner in a financial pickle because you haven’t been able the market the property for re-lease? If so this could also lead to further bond disputes & tribunal orders as you have not been able to remind them of their obligations when ending a tenancy (Yuck Messy Vacates!!) I can understand the concerns for PM in NSW with these changes alone. Margaret www.dmrealty.com.au |

I have so far lodged 3 complaints through the Office of Fair Trading. Our landlords are fuming so we have advised them to lodge complaints as well. NSW government is only going backwards with these changes. It really seems like they are trying to discourage as many new landlords as possible. |

I’ve spoken with Sam Kremer, Legal Counsel for the REINSW this morning & he said that they have documented some of the major concerns within this article http://www.reinsw.com.au/default.aspx?ArticleID… Sam said that they have had over 100 submissions from Agents & Landlords but need a whole lot more to have the required impact for the government to sit up & take notice. As usual the NSW Govt have only provided 1 months notice for submissions & end of month communications went out last week which would’ve provided the perfect opportunity to alert landlords en masse. It would be great to see a number of the apmasphere community jump in & have their say. If they get this through I believe it could set a benchmark that other states will also consider following. ( I wish they’d stop using NSW landlords as guinea pigs). |
