Has anyone ever taken a Landlord to Tribunal?   3 replies   3 voices

As Property Managers, we often have to take tenants to tribunal, and are sometimes taken to tribunal by tenants. I know tenants take landlords to tribunal when they are having a private rental issue. But as a Property Manager, have you ever taken, or heard of someone taking, one of their landlords to tribunal?

Just before Christmas I heard a tale of a PM taking a Landlord to tribunal as they were refusing to return to tenants overpaid rent. The agent took the funds from their own pocket to give to the tenants, and as the landlord still wouldn’t pay up, a tribunal case was sumbitted.

I have never heard of a similar case, so I have been eagerly awaiting the outcome, but apparently they paid up & the case was finally called off.

I am very interested to hear if any PM’s have taken a landlord to tribunal & some details about circumstances, outcome etc.

Geesh, V interesting….. we’d also love to hear of any such circumstances. I would assume it would be in best interest of both parties that it was resolved at mediation. Must be very awkward relationship for it to get to that point.

Why would the agent pay the money out of their own pocket?  Surely it would be up to the tenant to chase the owner through tribunal to get their money back.

Although I can see how this would be a big win for customer service to the tenant.

No Robert, the agent didn’t have to pay the money out of her own pocket, but she is a small office in a small town, and she was very aware that what the landlord was doing was illegal. It was $600, and right before Christmas, and the agent just wanted to do what was right (by the way, she is the PM, but also the owner of the business).

Jen – I’m not sure the management is still held by the agency, although I cannot confirm this. As far as I know, the case didn’t even get to mediation. As soon as the landlord received the notice for tribunal in the post the funds came straight in!
