if it wasn’t so serious you’d laugh. We lodged a claim on Feb2, got a hearing date set for 28 Feb..!! Tenant is 4 weeks in arrears, yard a mess.. So now we have long waits on URGENT matters.. last week, I’m in for my 2.30 hearing, at 3.30 we’re still waiting, but worse, there’s some chaps that have flown in from the bush, had been in/out during other matters since 10.30..!! Finally got the 5 minutes I needed at 4.00..! And here we are today, all ready to go at 10.30, 11.00 rolls around and the clerk comes out to check the attendee list for 10.30, then again at 11.15 to check the list of 11.00ers…. then again at 11.35 to advise that there will be no more hearings today due to the 9.30s still going through, and she will have to ‘apply’ to QCAT in the city for extra hearing days and hopefully they can fit us all in around the next “couple of weeks..!!” What an almighty joke this body has become. Back in 1989 the Queensland Govt. removed the Residential Small Claims from the general Claims system due to the enormous backlog it was creating and along the way created RBA, soon to become RTA and eventually we had our own Residential Tenancies Tribunal. For some unknown reason, the position has been entirely reversed, and in the 2 years that QCAT has been running, here we are back at the start, with all of the same issues. I wonder if our colleagues in NSW and VCAT have the same delays and issues, and if so, what do they do about it.. As I said, if it wasn’t so serious it’d be funny.. Ian Morrison |

Fully understand, have a bond dispute that is going to QCAT, tenants lodged the dispute mid January, will be heard before the court mid April. Way to leave everyone hanging. |

I had the same thing end of last year. lodged for termination- failure to leave (tenant had not paid rent since the day she moved in) on 1 nov 2011. court date was 6 feb 2012. our court only sits for qcat 1 afternoon a fortnight. No we are not located in the middle of the Aust outback… only an hour west of Brisbane! so poor owner had to pay 2 mortgages over xmas. |

Yea, these are the kind of effects that disturb me. Whilst the system bogs down in whatever useless methods they employ, home owners (our clients) have to foot the bill. I have one now, who is 6 weeks in arrears, and the Claim date is still 28 Feb away. Mind you, I’ve taken to the old days of bashing on doors and serious warnings by way of letter and E-mail to advise arrears payers that I am in their face, and their best bet is to get as far away from my office as soon as possible.. about all we can do under the current circumstances. Comments along the lines of “we will be seeking to list you on TICA” and “we require your advice as to when your keys will be handed in to our office to avoid Police Eviction procedures..” Not happy Janet..or should I say Anna.. |

It really leaves the fact that the maximum bond that can be collected is 4 weeks when you have to wait so long to lodge a court hearing, then even longer to wait to be heard. When qcat rules above & beyond the bond, how often do the tenants pay the additional outstanding monies? |

I wont complain about VCAT again. Make an Application and hearing takes place usually under 3 weeks, it’s unusual that the matter hasn’t been heard within an hour of the scheduled time. Vary rare that it takes longer than that. |

Ah, the mighty systems that is Victoria Don, good news for you and your clients. Funny thing is that our (original) RBA was modelled on the Victorian system in place at the time. It’s obvious that the Qlders haven’t quite managed the implementation so well. Ian |

I know of one VCAT Member who moved to Qld to help set up the administration of QCAT, obviously that helped a lot! I’ll whinge about some of their decisions but the process and VCAT On-line is the greatest thing since sliced bread. |

Yes Don, obviously he helped..not..! Just back from a 9.30 hearing. Clerk came out @ 9.45, checked the appearances, of which there were just two from a list of 10, and then advised us that due to the workload there was no gaurantee they would even get through ‘all’ of them today..???!! As I’ve said, what a joke coming from a public service body. I’m intrigued though Don, what’s VCAT On-line..? How does it work, what does it do, what can you do with it..? Elections now due in Qld, just may be an opportunity here for change.
